How to Look Up a Court Case in Skagit County?

Odyssey Portal Document Access (Subscription)

The Skagit County Clerk’s Office offers electronic access to Superior Court case documents through a registered Odyssey Portal subscription. The annual subscription fee is $200 per user if paid before January 15, with prorated monthly rates of $20 per month after that date. Subscribers can view and print documents in the following case types:

In-Person Access

Anyone can view public case documents at no charge on the computer kiosks located in the Clerk’s Office lobby during regular business hours (Monday through Friday, 8:30 a.m. to 4:30 p.m.). Public access terminals also provide access to JIS case management data.

The District Court Clerk’s Office is open 8:30 a.m. to 12:00 p.m. and 1:00 p.m. to 4:30 p.m., Monday through Friday. Specific inquiries can also be directed to dedicated email addresses for civil matters, criminal matters, billing, and infractions.

Historical Records

The Washington State Digital Archives maintains digitized Skagit County Superior Court case files dating from 1900 to the present. This resource can be helpful for locating older records that may no longer be readily available at the courthouse.

Are Court Records Public in Skagit County?

Under the Washington Public Records Act (RCW 42.56), government records — including court records — are presumptively open and accessible to the public. Washington’s court-specific access framework is governed primarily by General Rule 31, which establishes that all court records shall be available for public inspection except where restricted by federal law, state law, court rule, court order, or case law.

The Skagit County Clerk’s Office publishes a detailed Access to Court Records brochure that outlines what is and is not available. There is no fee to view court documents at the courthouse, though copying fees apply as listed above.

Records restricted from public access include:

  • Adoption records (RCW 26.33.330)
  • Mental illness commitment records (RCW 71.05.620)
  • Alcohol and drug treatment commitment records
  • Paternity records, except final orders (RCW 26.26.610)
  • Juvenile non-offender records (RCW 13.50.100)
  • Confidential name change records (RCW 4.24.130)
  • Records sealed by judicial order
  • Information protected by attorney-client privilege
  • Personal identifying information such as Social Security numbers, driver’s license numbers, and home addresses

Family law and guardianship cases carry additional restrictions under General Rule 22. Sealed financial source documents (tax returns, wage stubs, bank statements), sealed personal health care records, retirement plan orders, relocation notices, and detailed portions of certain evaluative reports are not available to the general public. A person seeking access to restricted family law documents must file a Motion and Declaration to Allow Access to Records Under GR 22©(2) with the court of record and obtain a judicial order granting access.

When a court orders a document or entire case file sealed, the public cannot view or copy those materials. However, records acknowledging the existence of sealed documents or cases remain accessible unless specifically restricted by statute.

Juror names are publicly available, but all other juror information is confidential. Anyone needing additional juror details must petition the trial court and demonstrate good cause.

Skagit County Criminal Court Records

Criminal matters in Skagit County are split between two courts based on severity. Felony cases — including those involving serious violent crimes, drug trafficking, and other indictable offenses — are prosecuted in the Skagit County Superior Court. Misdemeanors, gross misdemeanors, and traffic-related criminal offenses are handled by the Skagit County District Court or the relevant municipal court.

Statewide Criminal History Checks

The Washington State Patrol (WSP) maintains criminal history records for Washington residents, including Skagit County. Criminal background information can be obtained through three methods:

  1. Online via WATCH: The Washington Access to Criminal History system provides instant conviction-based background checks for an $11 fee, payable by Visa, MasterCard, or American Express.

Skagit County Sheriff’s Office

The Skagit County Sheriff’s Office Records Division processes requests for police reports and arrest-related records. Requests should be submitted in writing through the county’s NextRequest portal, though phone and in-person requests are also accepted. Criminal filing fees imposed upon conviction in Superior Court include a $200 filing fee (per RCW 10.01.160) and a crime victim penalty assessment of $500 for felonies or gross misdemeanors, or $250 for misdemeanors.

Skagit County Civil Court Records

Civil cases in Skagit County are divided between the Superior Court and the District Court based on the amount in controversy and the type of claim. The Superior Court has general jurisdiction over civil matters without a dollar cap, while the District Court handles civil claims up to $100,000, small claims filed by individuals up to $10,000, and small claims filed by businesses up to $5,000. The District Court also handles unlawful detainer (eviction) proceedings, name changes, and protection orders.

Family law cases in Skagit County are adjudicated in the Family Law division of the Skagit County Superior Court. Divorce Records

Dissolution (divorce) records are court records maintained by the Skagit County Clerk. The Clerk’s Office handles in-person, email, and mail requests for copies. The standard copy fees apply ($5.00 for the first certified page, $1.00 for each additional page).

Marriage Records

Marriage licenses in Skagit County are issued by the Skagit County Auditor’s Office. The license fee is $164.00. The county also maintains a searchable marriage license database online. Skagit County Probate Court Records

Probate proceedings in Skagit County are handled by the Skagit County Superior Court. The Clerk’s Office serves as the custodian of all probate records, which encompass estate administration, will filings, will contests, guardianships, conservatorships, and trust registrations.

Probate and guardianship case data is available for free through the Odyssey Portal and the statewide case search system. Subscribers to the Skagit County Odyssey Portal can view probate documents remotely. Non-subscribers can view documents on the public kiosks in the Clerk’s Office lobby at no charge.
