Are Court Records Public in Grays Harbor County?
Court records in Grays Harbor County are generally open to public inspection. Two overlapping legal frameworks govern access: the Washington Public Records Act (RCW 42.56) and Washington General Rule 31 (GR 31). The Public Records Act ensures that records prepared, owned, used, or retained by state and local agencies are available for inspection and copying. GR 31 addresses court records specifically, recognizing that public access must be balanced against reasonable privacy expectations.
Government agencies are required to make records available during published office hours, assist requesters, protect records from damage, and respond to mail requests in a timely manner. However, access is not unlimited. Certain categories of court records are restricted or redacted, either by statute or court order.
Records that may be sealed, restricted, or redacted include:
- Adoption records
- Juvenile records
- Dependency case files
- Paternity case files
- Mental health case files
- Family court mediation files
- Personal identifying information (Social Security numbers, driver’s license numbers, dates of birth, home contact details)
- Intelligence and investigative records compiled by law enforcement
- Financial and commercial information that is confidential under statute
- Information identifying child victims of sexual assault under age 18
- Information revealing the identity of crime victims or witnesses where disclosure would endanger safety
The Grays Harbor County Clerk’s Office records page confirms that confidential case types — dependency, truancy, paternity, mental health, and adoption — cannot be accessed without a court order. Closed case files are stored at an off-site facility and can be retrieved within three business days upon request.
For non-court administrative records, the county maintains a Public Records Request Portal where individuals can submit formal requests. Administrative court records are governed by GR 31.1, which is distinct from the rules governing case records.
